How Will You Resolve Your Divorce?

When people think of a divorce or other lawsuit, they often envision the worst of the worst.  While the length and expense of the proceeding is mostly dictated by the issues to be resolved and the parties involved, de Beer and Associates, P.A. offers different methods of resolving your case in order to minimize the time until your case is resolved and the amount of fees you will spend.

Drafting Agreements. Sometimes parties work out their agreements on their own and simply need those agreements to be put into a legally enforceable document.  de Beer & Associates offers this service.  You can meet with one of our attorneys, discuss the terms necessary to finalize your case, and have one of our associate attorneys quickly draft the documents necessary to effectuate and finalize your agreements.

Alternative Dispute Resolution (ADR).  ADR is an alternative to litigating in court that involves an independent third party called a "neutral."  The use of ADR methods such as mediation, Early Neutral Evaluation (ENE), or Financial Early Neutral Evaluation (FENE), can help parties come to agreements more quickly and with less cost.  The attorneys at de Beer and Associates are experienced in guiding their clients through these alternative processes and can assist you in choosing the neutral facilitator that is right for your case.

Collaborative Law.  Collaborative Law is an alternative to ligation and focuses on minimizing the conflict between parties.  To utilize Collaborative Law, both parties and their attorneys agree to make a good faith effort to resolve the case without going to court.  Agreements are reached through a series of meetings instead of court hearings.  All of our attorneys are trained in Collaborative Law.  Click here to learn more about resolving your dispute collaboratively including the process, advantages, considerations to determine if Collaborative Law is right for your case, and our attorney's Collaborative Law profiles.

Litigation. Sometimes the issues in a case or the personalities of those involved require a case to be litigated because it cannot be resolved with an alternative method.  In those circumstances, the attorneys at de Beer & Associates are equipped to fight for your goals.  We have many years of experience in pre-trial and post-trial litigation and will facilitate a plan to effectively present your case to the court.

Experts. Whether your case needs to be litigated or can be resolved in an alternative method, many clients engage experts to assist them in reaching a resolution or presenting their case to the court.  If there is a custody dispute, a Custody Evaluator may be needed to recommend parenting terms that are in your child's best interest.  If there are ongoing parenting disputes, a Parenting Consultant may be needed to assist the parties in resolving those ongoing difficulties.  If there are complicated financial decisions to be made, a Financial Neutral may be needed to calculate tax effects and guide you to a fiscally responsible division of assets, debts, and income.  Other experts often engaged are actuaries, therapists, and vocational evaluators.  The attorneys at de Beer & Associates can help you determine whether an expert is needed to assist you in resolving your case and in choosing the expert that is right for your case.
