Dissolution of Marriage (Divorce). We recognize the difficulty in getting through the breakdown of a marriage and offer legal guidance to assure that you, your children, and your finances are protected through the dissolution process and into the future. Understanding how to best end a marriage requires an understanding of the dynamics of the relationship and the concerns and goals of our clients. Child Custody & Parenting Time (Visitation). When parents decide to end their relationship, children are the first concern. Our attorneys are equipped to assist you in making child-focused decisions and reaching agreements that will help your children transition through this difficult time. Property Division. In order to protect your and your children's financial future, we will assist you in determining what property is marital and non-martial, equitably dividing your assets and debts, considering the tax effects of those divisions, and completing the legal documents necessary to transfer property. Child Support. The Minnesota legislature recently amended the laws regarding child support. Child support is now determined based on the income of both parents, the percentage of time spent with the child, and some additional factors. We will assist you in determining whether you or your spouse has a claim for spousal maintenance (alimony) and how to best negotiate that claim or defend against it.
Legal Separation. Legal separation is an alternative to marriage dissolution that allows a couple to remain legally married. Our attorneys will discuss with you the advantages and disadvantages of legal separation and assist you in determining whether legal separation is right for you and your family.
Paternity. A Paternity action determines the legal father of a child and may also involve determinations of custody, parenting time, and child support. While Paternity actions do not involve ending a marriage or division of property, they can be complex lawsuits.
Third Party Custody. Sometimes children are best cared for by a third party such as a grandparent, aunt, or uncle. Our attorney will discuss with you whether you meet the requirements to seek third party custody.
Post-Decree Motions. Many times after a Dissolution of Marriage or Paternity case is resolved, circumstances change that require a modification of the terms of your settlement or the court's decision. Our attorneys will discuss with you your options for modifying prior decisions regarding child custody, parenting time, child support and spousal maintenance.
Antenuptial (Prenuptial) and Postnuptial Agreements. Antenuptial agreements are contracts that people enter into prior to getting married which set forth their rights to property and support in the event of divorce or death. Postnuptial Agreements are contracts that couples enter into after their marriage setting forth their rights to property and support in the event of divorce or death. Our attorneys can assist you in determining whether you need a written agreement, drafting the agreements, and defending against Antenuptial and Postnuptial Agreements.
Appeals. An appeal is when a party requests that the Minnesota Court of Appeals or Minnesota Supreme Court reviews the district court's decision because the party believes that the district court should have made a different decision. Our attorneys can represent you in seeking an appeal or in defending against an appeal initiated by the other party.
